These terms require legal drafting before publication
Publication pending. What follows is the structure these terms must cover, prepared so that counsel drafts against a complete list. It is not drafted legal text and must not be published as though it were.
Blocked on dependency D3.
What the drafted terms must cover
- The contracting entity — legal name, registration and registered address
- Scope — what these terms govern, and what is governed by the separate programme agreement
- Nature of the service — nutrition and lifestyle guidance, explicitly not a substitute for medical diagnosis or treatment
- Eligibility, including age, and consent requirements for minors
- Programme enrolment — fees, duration, what is included and what is charged separately
- Cancellation and refunds, stated plainly enough that a reader can act on them
- Consultation conduct — what a consultation is and is not, and the escalation-to-a-doctor position
- Third-party services — laboratories, treatments, AYUSH consultations and testing partners
- Intellectual property in plans, content and the assessment instrument
- Acceptable use of the website
- Limitation of liability, drafted against the Consumer Protection Act 2019 — note that liability for healthcare services cannot simply be excluded
- Grievance redressal, with the officer named and a stated response time
- Governing law and jurisdiction
- How changes to these terms are notified
